Dalyan Holiday Rental Agreement
1. In this agreement, the one who rents the villa/apartment will be referred to as "Tenant" and the one who rents the villa/apartment will be referred to as "www.dalyanholiday.com".
2. This agreement has been made between the Tenant and Hakan Savran for the rental of any apartment or villa listed on the website www.dalyanholiday.com and the marketing channels of domestic and foreign business partners for a period with predetermined start and end dates.
3. By sending a request to the relevant villa or apartment through the marketing channels of domestic and international business partners via www.dalyanholiday.com, paying the down payment and completing the reservation, the Tenant and his/her entourage accept the following conditions in advance. Violation of any of the following conditions, www.dalyanholiday.com unilateral cancellation of the reservation; It gives the tenant the right to ask the tenant to leave the villa/apartment and not to refund the payment received.
4. Tenants cannot transfer their rights and obligations arising from this agreement to third parties without the approval of www.dalyanholiday.com; may transfer its rights and obligations arising from this agreement to third parties.
5. In order for the reservation to be made, 15% or 30% of the total rental fee (varies depending on the villa/apartment) is taken as a prepayment. After the prepayment is made, information about the reservation is sent to the Tenant via e-mail. By making the prepayment, the Tenant accepts the terms and conditions in this agreement. The tenant is obliged to pay the remaining payment in cash when entering the relevant villa.
6. If the tenant wishes to check out or checks out for any reason after checking in, no refund will be made.
7. www.dalyanholiday.com issues a service fee invoice as it acts as an intermediary between the Tenant and the villa/apartment owner regarding the rental made. Since the remaining part of the total amount paid by the tenant is the income of the villa/apartment owner, www.dalyanholiday.com is not responsible.
8. The prepayment sent for the reservation is non-refundable. (except for the prohibitions determined by the District Governorship and Governorship such as war threat, terrorist activities, natural disasters, pandemic-related curfew, travel ban)
9. If the cancellation of the reservation is made by the villa/apartment owner or www.dalyanholiday.com; www.dalyanholiday.com is obliged to refund the entire prepayment made by the tenant.
10. JustVilla is a website that acts as an intermediary between villa/apartment owners and Tenants and is responsible for any problems that may occur regarding the rented villa/apartment (accident, illness, fire, theft, death, drowning, sightseeing, shopping, food, entertainment, transportation, travel, does not accept responsibility for power outages) and all responsibility belongs to the owner of the villa/apartment. www.dalyanholiday.com is responsible for transferring complaints from tenants to the relevant persons as quickly as possible.
11. No extra fee is charged for expenses such as pool and garden cleaning, electricity, water and internet.
12. The personnel responsible for pool maintenance must enter and be in the required areas at certain hours in order to perform periodic maintenance.
13. Entrance cleaning is included in the price for daily, weekly and monthly rentals; For rentals of more than one week, weekly cleaning is included in the price. Requested extra cleanings are carried out for a fee, depending on the availability of the cleaning companies.
14. Due to the special request of some of our villa or apartment owners, a cleaning fee may be requested for reservations under 7 nights, or rentals under 7 nights are not allowed.
15. In options with heated pools, the temperature of the pools varies between 20 Celsius and 29 Celsius. www.dalyanholiday.com is not responsible if the pool does not heat up due to a power outage.
16. JustVilla is not responsible for diseases and allergies caused by the water coming from the swimming pool and shower of the rented house.
17. www.dalyanholiday.com is not responsible for the animals, pests, insects and manure-related odors found around or within the rented apartment/villa. Such situations may occur in villas located in nature.
18. When entering the villa/apartment, a damage deposit in the amount determined by the villa owner is taken; If there is no damage and the house is left clean, it will be returned upon departure; If any damage is detected at the exit, this damage will be collected from the deposit and the remaining amount will be refunded to the Tenant; If the deposit is not sufficient to cover this damage, the remaining amount will be collected from the Tenant in cash at that time.
19. If the immovable property is not used as its own property and/or is not kept away from possible dangers, in accordance with the law and general moral rules, in a clean, careful and attentive manner and in accordance with the agreement and understanding, while the immovable property is left under the control of the tenant for use, the visitor is liable to the immovable owner in proportion to his fault. will happen, www.dalyanholiday.com will not be held responsible at all.
20. Tenants should be understanding of the neighbors around the house they are using and should avoid any behavior or noise that may disturb the environment. In addition, they should not engage in any illegal activities (weapons, drugs, any kind of smuggling, etc.) that are prohibited by law. In such a situation, www.dalyanholiday.com reserves the right to evacuate the house immediately and without warning. OnlyVilla cannot be held responsible for any damages or losses that may occur during evacuation due to the aforementioned reasons. This agreement ensures that the house cannot be rented to anyone else on these dates. In case of disaster or force majeure, this contract will be invalid.
21. It is not allowed to accommodate more people than the person capacity specified on the detail page of the villa or apartment to be rented on our website; If there are more people than the specified number of people, the villa/apartment owner has the right to evict these people from the house or request an additional fee. Every child over the age of 2 is included in the number of people to stay and the number is calculated accordingly. The extra fee is 2000 TL per night.
22. Pets and smoking are not allowed in the rented villa/apartment unless otherwise stated.
23. According to the Decree Law No. 678 of the Tenant, the Identity Notification Law published in the Official Gazette No. 29896 dated 22 November 2016; Before entering the villa, the person is obliged to inform the company official or the person or persons designated by the company about the identities (Identity Card, Driving License, Passport) of all persons who will stay in the villa/apartment.
24. Check-in time to the villa is 16:00 at the earliest and check-out time is 10:00 at the latest. The remaining 5 hours are reserved for cleaning. Late check-out or early check-in is permitted only in appropriate cases.
25. It is recommended that tenants have personal insurance such as life, health, theft and travel insurance.
26. If the tenants engage in behavior that may disturb the environment or constitute a crime during the rental period, www.dalyanholiday.com has the right to cancel the reservation of the tenants and no refund will be made.
27. A 100% guarantee cannot be given that the villas in the sheltered category (the pool is not visible from the outside) will not be visible from the outside and www.dalyanholiday.com does not accept responsibility in cases that may occur.
28. JustVilla does not share Tenants' personal information such as name, surname, address, telephone number, e-mail address with third parties; This information is used to obtain statistical data and provide campaign information. It makes great efforts to prevent data from falling into the hands of malicious people. For this reason, credit card information is not stored in the system in any way. If this data falls into the hands of third parties as a result of cyber attacks; www.dalyanholiday.com does not accept liability.
29. Tenants are responsible for transportation to the apartment or villa they rent.
30. The landlord is responsible for any dissatisfaction or problems that may arise regarding the road, geographical location, decoration and materials used in the rented villa/apartment.
31. Only the geographical location data provided by Villa is approximate.
32. Accidents, problems and deaths that may occur due to the facilities used in the construction of the property or the facilities it offers; Additionally, www.dalyanholiday.com is not responsible for health problems such as insect bites, poisoning, allergies.
33. JustVilla is not responsible for any problems that may occur such as insects and pests in our villa/apartment options that we offer in touch with nature.
34. It is not possible to cancel the reservation as a result of changing the color or some decoration products in the pictures on the website www.dalyanholiday.com.
35. In cases of cancellation of leave of public or private company employees, the rental conditions are fully valid.
36. In case of malfunctions caused by the rented house and cannot be repaired, payment is made by calculating the number of days not stayed in the house, and the fee for the days stayed is not refunded.
37. The tenant must enter the rented apartment or villa on the promised date and submit the remaining payment; If the tenant wishes to check in on a different date within the reservation period, he/she is obliged to pay the entire remaining reservation fee on the actual starting day of the reservation. In case the payment is not made, YalnızVilla has the right to take legal action.
38. Tenant, T.R. In accordance with Article 15/g titled Exceptions to the Right of Withdrawal of the Regulation on Distance Contracts dated 27.11.2014 and numbered 29188 in the Official Gazette of the Ministry of Industry and Trade, the person will not be able to exercise the right of withdrawal in any way.
39. The Tenant who makes a reservation for any villa or apartment is deemed to have fully read and accepted the above terms and conditions. Any behavior contrary to these terms and conditions gives www.dalyanholiday.com the right to unilaterally cancel the reservation, not to provide a refund and to demand the full fee.
40. Severability: If any of the non-essential provisions or part of the Agreement is partially or completely legally invalid and it is understood that the remaining provisions of the Agreement are enforceable without this provision or part, this situation applies only to that provision or part. and will not affect the validity or enforceability of other Agreement provisions.
41. The tenant is deemed to have accepted the "Privacy and Security Policy" with this agreement.
42. Muğla Ortaca Enforcement Offices and Courts are authorized for disputes that may arise on issues related to this contract
